Terms & Conditions

These Terms & Conditions apply to all services provided by Custom Sites. Acceptance of a quote and its associated Terms & Conditions is confirmed by payment of the deposit or invoice.
Website Design & Development
Scope of Services
The quote covers the design and development of the website, including the number of pages and services specified in the quote.
Any additional pages or features requested by the client will be billed at R799 per page or as per a separate agreement.
Revisions
The quote includes two rounds of revisions. Each revision is limited to one hour of work. Additional revisions will be charged at R300 per hour.
Payment Terms
- A 50% deposit is required before work commences.
- The remaining balance must be paid upon project completion and before the website is made live.
- Payments are to be made via EFT or other agreed-upon methods.
Timeline
The project will be completed within 10 business days, provided all required content (text, images, etc.) is supplied by the client within 3 business days after the deposit is made.
Hosting and Maintenance
The first month of hosting and maintenance is included in the quote.
Thereafter, hosting and maintenance will be billed monthly in accordance with the selected hosting package as specified in the accepted quote.
Where subscription-based billing is used, the initial payment amount may be adjusted to account for the included first month of hosting. Ongoing monthly hosting and maintenance fees will commence from the following billing cycle.
Monthly fees are billed in advance on a recurring billing date, determined by the date of the initial payment.
Hosting and maintenance services are provided on a month-to-month basis unless otherwise agreed in writing. Fees may be subject to change with prior written notice.
The website will remain in maintenance mode and will not be made publicly accessible until the initial payment has been received and confirmed.
Basic maintenance is included as part of the hosting service. This covers essential updates, uptime monitoring, and minor technical support to keep your website running smoothly. Any additional maintenance or custom work beyond this scope can be arranged at an extra cost.
Failure to make monthly hosting and maintenance payments may result in suspension of the website. If payment is not received within a reasonable period after suspension, the website and associated data may be removed.
Maintenance & Security Disclaimer
While reasonable steps are taken to keep your site secure, no system is 100% immune to hacking or malware. Any damage or data loss caused by such incidents falls outside the scope of our liability.
If you choose to manage and pay for your own hosting service, please note that we will not provide technical support after the website has been completed. Any required assistance will be subject to our standard support rates.
Mobile Responsiveness
The website will be optimized for mobile devices. However, certain complex customizations may incur additional charges. You will be notified in advance if these changes will result in extra costs, and any additional work will only proceed once you have given approval.
Basic SEO Setup
Includes setting up page titles and meta descriptions for the website's main page, helping improve visibility on search engines. This also includes submission to Google Search Console and basic indexing support.
Advanced SEO
Includes keyword research, image alt text, and other optimization strategies to improve search engine visibility. Advanced SEO can be requested at an additional charge.
Content Provision
The client is responsible for providing all necessary content (text, images, logos) for the website. Delays in content delivery may extend the project timeline.
Cancellations and Refunds
If the project is cancelled after the deposit is paid, the deposit will be partially refunded based on work already completed, with a maximum refund of 25%.
In the unlikely event that the designer cannot complete the project, a full refund of the deposit will be made.
Liability
The designer is not liable for any losses, damages, or expenses arising from the use of the website, its functionality, or any associated services.
Ownership
Upon full payment, the client will have full ownership of the website and its design. This ownership does not include hosting services, third-party software, plugins, licenses, or infrastructure, which remain subject to their respective terms.
The designer retains the right to showcase the website in their portfolio unless explicitly requested otherwise.
Confidentiality
Any client information or materials shared during the project will remain confidential and will not be used for any other purposes.
Email Setup & Configuration Services
Scope of Service
The service includes the setup and configuration of business email accounts using third-party platforms such as Google Workspace or Microsoft 365, as specified in the quote. This includes account creation, DNS configuration (MX, SPF, DKIM, DMARC), basic security setup, and initial verification.
Service Nature
This is a setup and configuration service. Ongoing email hosting, storage, uptime, and infrastructure are provided directly by the respective third-party provider (Google or Microsoft) under their own terms and service agreements.
Subscription & Billing
All subscription fees for Google Workspace or Microsoft 365 are billed directly by the platform provider unless otherwise agreed in writing. The service provider is not responsible for subscription pricing, billing disputes, or changes in third-party fees.
Third-Party Infrastructure
Email services rely entirely on third-party infrastructure. The service provider does not control and cannot guarantee uptime, performance, security, backups, or availability of the email platform.
Security Disclaimer
While industry-standard configuration practices are followed, no email system can be guaranteed to be fully secure. The service provider is not liable for data loss, email interception, malware, account compromise, or unauthorised access beyond reasonable configuration measures.
Backups & Data Responsibility
Clients are responsible for maintaining their own backups and data retention policies as required for their business or regulatory needs.
Support Scope
Support is limited to initial setup and basic configuration assistance. Ongoing mailbox management, user support, device setup, data migration, troubleshooting, or advanced configuration may incur additional fees unless covered under a separate support agreement.
Cancellation & Account Control
Email accounts remain under the client's control within the respective platform. Cancellation of subscriptions must be managed directly with the provider unless otherwise agreed. Failure to maintain active subscription payments may result in suspension or data loss in accordance with the provider's policies.
Limitation of Liability
The service provider shall not be liable for any direct or indirect losses arising from the use, suspension, interruption, or termination of third-party email services.
